The Kansas National Guard was founded on October 16, 1861. The first regiment was organized in Haysville, Kansas. It was known as the 3rd Regiment, Kansas National Guard. On December 6, 1861, the 3rd Regiment became the 1st Battalion of the 5th Infantry Regiment of the United States Army and resigned its commission in order to rejoin the Union army. On November 12, 1862, a second battalion of the 5th Infantry Regiment was raised and it became known as the 2nd Battalion of Kansas Volunteers (1st Infantry Brigade). The 2nd Battalion served in Sherman’s Division duringthe American Civil War and died at Battle Creek December 15-18, 1864 while under heavy fire from Confederate forces near present day Wichita Falls. After the Civil War ended on April 9, 1865, all regiments in service with the United StatesArmy were mustered out and disbanded. In 1866-1867 two more battalions were raised for service within state guard organizations: 1st battalion of 4th Infantry Regiment (Kansas Volunteer Militia) and 2nd battalion of 5th Infantry Regiment (Kansas Volunteer Militia). These unit's histories are not currently available but they may have been disbanded or transferred later to other units when their original organization changed or when new unit rosters were adopted.
