The Palos Hills National Guard was organized on December 15, 1908 by the United States Congress as a national emergency organization to supplement the Regular Army during World War II. The 1st Battalion, 5th Regiment was activated on April 25, 1941 and became part of the 101st Airborne Division inactivated on October 16, 1944. The 2nd Battalion, 9th Regiment (later changed to 3rd Battalion) was activated on January 17, 1942 and became part of the 168th Infantry Brigade Combat Team inactivated on November 24, 1945. In 1958 the unit was re-designated as Headquarters and Headquarters Company/Palos Hills National Guard. In 1978 it became an organic battalion under command of the Illinois State Police Department. On February 14, 1991 it was redesignated again as Headquarters and Headquarters Company/5th Regiment National Guard because there were no active duty military units assigned to that name within Illinois at that time. It reverted back to its original name effective March 1st when all active duty military units within Illinois were reassigned to other commands or disbanded entirely. On September 20, 1996 members of 3rd Battalion received orders from General John Harkavy giving them permission to leave for Bosnia after years of planning and preparation by battalion commanders working with NATO planners. Upon return they found their unit had been dissolved while deployed without proper notification or equipment storage so they sued US Forces Europe LLC for wrongful disbandment which finally ended their lawsuit in 2003 but did not restore their unit's former designation or funding status quo ante; instead it remains an "inactive" battalion with no officers or soldiers serving currently authorized tours due to lack of funds necessary for such a permanent structure
